Legal Question in Criminal Law in California
civil
Thank you Mr.Berlin and Mr.Hoffman, but I think I may need to explain just a little further, my sister and her friend called and demanded 10K for an outstanding loan due from my daughter, when I told them they needed to take it up with my daughter, they filed a police report stating I fraudently signed my sisters name on the loan docs. In the state of Ca, the accused is not allowed copy of the police report, so I took down all evidence pertaining to her claim and proved I did not sign her name fraudently, I am waiting a decision from a P.O. for a copy of the report. They then told friends and family members that I did this, my ''sister'' has since moved to North Carolina. She has smeared my name, however 20K plus in lawyer fees will leave me with just that. I want to file a complaint against them both-the friend was the one calling on my sisters behalf-I want to know if they committed a crime, other than Defamation and intentional infliction of emotional distress?

Re: civil
Depending upon how the demand for 10K was presented it may have been blackmail. That is a crime in California.
