Legal Question in Criminal Law in California
Claim against a bond
What are the statue of limitations to file a claim against a bond? A company put in a cesspool in my yard on Dec. 2003. The cesspool backed up into my house on Dec. 2008. Just found it was not up to City code and did not have permit. Trying to figure out if I need an attorney or small claims court for the whole case. Pls. help. Thanks so much for your time.

It depends on the cost of fixing it. Small Claims Court can award you up to $7500. Is that enough? If so, you don't need an attorney. If you had no reason to know the work was not up to code, then the statute of limitations does not begin to run until you learn or reasonably should have learned. It sounds like you are okay on that issue.
