Legal Question in Criminal Law in California

Confidential Informant - Denies Controlled Buy

Search warrant issued on my residence, based on confidential informant and controlled drug buy. Took CI to small claims to try and recoup some of my bail but he denies participating in buy. Yet arresting officer/affiant gave CI's name in superior court. I was not charged with what the warrant was for, which is why I have the small claims case. Due to the fact that under oath in small claims he denies involvement, what are my options for getting bail back or possibly using the information in superior court.

Re: Confidential Informant - Denies Controlled Buy

First of all, neither I nor any other attorney

can render legal advice to you without a full study

of all the particular facts of your case.

Second, I am a criminal defense attorney and

I would think a civil or civil rights attorney

might best be able to advise you. It seems obvious

IF YOU TRUELY CAN PROVE PERJURY then you would have

a cause of action against one of them at least.

Third, since you speak of Small Claims Court in

the past,I assume you did not have the officer there

subpoenaed to testify....... bad move. Since you

were the plaintifff, you have no appeal rights.

Bottom Line: see a civil specialist for advice.

Good Luck.
