Legal Question in Criminal Law in California
what are the consequences for being caught with 5lbs of weed with no prior record? What are the consequences if you already have 2 strikes and are on parole?
1 Answer from Attorneys
For five pounds, you'll likely face transportation and/or possession for sales charges. The good news is that there are no weight enhancements for marijuana. The sentence could range from time in county jail and probation up to three years state prison.
If you have two prior strikes, any new felony subjects you to a potential 25-life sentence. Many people are confused about what they truly have on their record. Not every felony is a strike. Only serious or violent offenses are strikes. (Things like murder, rape, kidnap, etc are strikes)
If you're on parole, you can face and additional year in state prison under Penal Code section 667.5(b).
For a more exact estimate of what you're facing, you'll need to sit down face to face with a criminal defense attorney to discuss the charges and your record.
