Legal Question in Criminal Law in California
Conspiracy
I have been charged with conspiracy to theft but the charges against the defendant I was accused of helping with the theft have been dismissed. How can my charges still apply? Thanks...

Re: Conspiracy
Even though a conspiracy must involve more than one person, not all of the conspirators have to be charged. The prosecutor can decide to go after only one if she wants, and can make this decision even after having initially charged more than one.
The issue at your trial will be whether you are guilty of conspiracy. Whether others have been charged is not terribly relevant to that question, and you probably won't be able to even get that information in front of the jury.
You need a lawyer to protect your interests. If you don't already have one, start looking.
Good luck.
