What constitutes 3 strikes in one case
I have been charged with 1 count of 1st degree burglary and 2 counts of attempted 1st degree buglary and was offered a deal of 4 yrs 8 months and 3 strikes on this one case. Is there any loop holes that can help me reduce these charges? I have a drug addiction and have been accepted twice to Delancy street drug rehabilatation in S.F. I am unable to afford legal counsel of any kind. I currently have a public defender who is unwilling to help me get into this program. The D.A. is also unwilling to hear from me that I am willing to get help for my addiction that had lead me to the crimes I am being charged. What are my options?

There is no loop hole. The DA is prohibited by law from talking to you while you are represented by an attorney. Your addiction to drugs is not unique for people in your position. The negotiated plea is not unreasonable for your case. Whethter a better plea bargain could be negotiated depends upon the facts of your case and your criminal history.
