you can try, but you need to make sure that you do not say anything incriminating!
It is not recommended for you to contact the prosecutor on your case. Our office has handled 100's of cases in the past that we have engaged the law enforcement agency and/or the prosecuting agency and have been successful in getting the case NOT filed. However YOU should NEVER atttempt that, as you don't know what you're doing and, assuming a prosecutor will even speak with you, any wrong WORD you say could hurt you. If you want a professional to handle your matter, I believe you should contact an attorney who knows how to handle criminal cases. If you want our help, I would be more than happy to speak about your case. ......................... David Wallin
Absolutely not.
First - no Deputy DA will speak with you directly. If you said something, they could absolutely use it against you, but that particular DA would have to recuse themselves (and potentially the whole office).
Next - Can they be persuaded not to file charges, yes.... but this is best handled by your attorney.
I can tell you that in every criminal case I have ever handled, the DA never spoke to me outside of court. All deals and discussions with the DA were done in court. Even on critical motion filings, the DA has waited until I appeared in court, and then told me that he or she would move to dismiss the charges.
You as the defendant would be bloomin' insane to ever speak to the prosecutor, the police, or the store detective for that matter. Keep your mouth shut and let the attorney you hire do the talking.
