Legal Question in Criminal Law in California
how many continuances can you getin a criminal court case
1 Answer from Attorneys
There is no set number of continuances. Under some circumstances, you might get several... or you might not even get one.
You can only get a continuance if you can convince the judge there is good cause (which is legal-speak for "a really good reason).
For instance, I did a murder case a couple of years ago where we were set for trial several times, but the DA provided new evidence shortly before each trial date. The judge ruled we were entitled to a continuance each time so we could review the new evidence and conduct our own investigation.
On the other hand, just waiting until the last minute is not good cause for a continuance. You are required to make diligent efforts to prepare for trial.
