Legal Question in Criminal Law in California

Corporal Assault

The husband of my friend was arrested in early December and has remained in jail ever since. They say the charges are ''corporal assault on a spouse'' and that the charges are a felony. What is corporal assault? Is it the same as domestic violence - It seems to me that usually people who are arrested on a domestic violence charge are released within a day or two.

Re: Corporal Assault

The charges appear to be the same. How long the person is held depends on the degree of injury inflicted on the victim spouse. The amount of bail is directly propotionate to the degree of injury and any prior history of domestic violence. The amount of bail also has some affect upon the ability of the party to get out of jail.
