Legal Question in Criminal Law in California

Court Orders

I have a Restraining Order against an individual. This person was just found guilty of violating that order and stalking. The judge, during sentencing, issued a "Stay Away" Order. What is the difference between a Restraining Order and a Stay Away Order?

Re: Court Orders

The stay away order like the restraining order requires the individual to stay away from you. The stay away order is a condition his probation. The stay away order remains in effect so long as defendant is on probation. The restraining order is valid for three years and may be renewed for three years. Both order have essentially the same effect.
