if a case was dismissed in the interst of justice, how can this same case be used in 3 strike sentencing?

Many cases involve multiple counts. Relatively few cases are dismissed outright in the interests of justice, but it is quite common for some charges to be dismissed that way while others remain and go to the jury. The remaining charges will often include strikes. If the defendant is convicted on one of those counts he will get a strike even though part of his case was dismissed in the interests of justice.
