Can they get Criminal Charges for items NOT police receipt ?

Local & federal police had a search warrant to look for drugs & something in relation to alleged biker gang patch. My family�s home was searched by police & a receipt of what was seized was given. Went to court twice & judge said no charges were filed. Now they received new charges for items of Evidence NOT on the itemized receipt the Police gave after the search. Can he legally be charged? Can the police do that? He lost his job when he was in jail a few days after the search & now can not afford a lawyer.

Prosecutors are not limited to the evidence seized from a suspect's home. There is no good reason why they should be.
