Legal Question in Criminal Law in California

Criminal Court Continuances

My ex boyfriend has been charged with Domestic Violence. He has had an arraignment and a pretrial. Every time I receive a subpoena to witness, Im informed that he has been granted a continuance. How many continuances can a criminal defendant get? And what is the statute of limitiations for Domestic Violence?

Re: Criminal Court Continuances

There is no set rule limiting the number of continuances that a court may give a defendant.

You should talk with the deputy district attorney that this case has been assigned to about the reason for all of the continuances. Explain why this is a hardship for you.

The statute of limitations stops running once a criminal complaint has been filed. These continuances should not result in the case being dismissed. You should discuss this with the deputy district attorney.
