If you're not guilty, I strongly advise you to not plead guilty, no matter what. You will be giving up the right to appeal and maybe the ability to get a job, ever. Usually if you refuse an offer from the DA the offers get better up to the day of trial.

Not sure of the issue as the DA does not make sentences...only offers..which may or may not change over time. Sometimes the DA makes a better offer...sometimes not. If a person does not accept the DA offer, the Court may or may not give an indicated sentence if the person were to plead guilty. Either way, the option to accept/refuse the offer is up to each person and after advise of counsel.
