Legal Question in Criminal Law in California
Criminal law - opening a closed record
If one is convicted of a misdemeanor, serves the sentence and completes the probationary period for petty theft (30 days with restitution) is the record closed? If the record is closed, and the offense was committed 30 years ago, is the record available to anyone doing a background check for employment?

Re: Criminal law - opening a closed record
The answer to your question is yes. An employyer could potentially find out about your criminal past. It depends on the depth of their inquiry or if your dealing with a govermaental agency they are sure to know of its existence. In that instance, an expungement is something you may want to consider. Please call our office at (800) 382-3100 for further information and of course the consultation is free. We look forward to hearing from you.
