My son (23) was charged on 3 counts -- petty theft/w/ prior, burglary(shoplifted a jacket from Nordstrom's), using a popcorn tin (tool). At first court appearance we were told that burglary/tools had been dismissed. In the complaint they put the burglary/tools charge back in. Is this allowable? Thanks!

Yes. Prosecutors can generally reinstate charges they voluntarily dismissed unless the statute of limitations has run.
