Legal Question in Criminal Law in California
Criminal Trespassing?
Last year I left a MAJOR department store chain for a new job. They soon after contacted me that I was involved in a ''suspicious'' investigation. While I assured them on the phone that I had never been involved in any suspicious behavior while working there they asked me to come in for an interview. I came in only to find that non of the people were there but me. Soon after i had a family emergency and was unable to have another interview before a date they had set. Due to that they have told me that I cannot shop in any of their stores for 24 monthes or it is criminal trespassing. I have never signed anything nor was I aware of a ''deadline'' to interview. They simply gave me some paperwork the last time I tried to shop there and told me to leave. I have never even been charged with anything. can they do that?

Re: Criminal Trespassing?
The stores are private property and the company can forbid anyone to enter, provided that its reasons for doing so are non-discriminatory.
Depending upon what they think you did, whether they are right and how much evidence they have (even if you are innocent there might be evidence which makes you appear guilty), it might be wise for you not to rock this particular boat and to find a new place to shop.
Trying to clear your name could cause you a lot more trouble than it's worth. You may want to consult with an attorney before you take any further steps toward resolving this problem.
Re: Criminal Trespassing?
Take your business elsewhere. And politely decline any future invitations to be interviewed or to go anywhere with anybody who is investigating an alleged crime. Just like the people on all those TV cop shows, if you volunteer to go to a police station you probably won't get to go home.
