my son took my car from my wife house where I stored my car. I have not live there in three . she reported stolen. they now have him in court, can they convict him though i says its was not stolen . im the legal ower

If your son had permission to take the vehicle then he generally cannot be convicted of stealing it. Despite your legal title, the DA's argument would likely be that your wife was the owner for practical purposes and did not give your son consent. So there are some factual issues here that would need resolution.
