Legal Question in Criminal Law in California
Critical health issues and time to serve in county jail
A friend of mines son lives in crescent city (del norte county)w/in the last year he has had a double bi-pass with complications b-4 and after. Within the last couple of weeks he was picked up on a warrant,he was released and told he had to return on the 31st of this month to serve 22 days. Due to his severve health issues both his mother and father as well as his wife are very concerned about the impact this will have on his already fragile health. We are in agreement that if we could pin down the cardiac surgeon (i.,e) that he to would be in agreement. Is there not a form that we can pull from west judicial or the like and take to the medical facility and present to the superior court that can have this time served in another manner?? I have been trying for 3 days now to use the ''ask now'' law librarian for both co co county and del norte but have have found no one is avail. And am running short on time...Please if you could help!!!!!
Thanking you in advance for your time. Ms.--name removed--kern

Re: Critical health issues and time to serve in county jail
A family member could write to the sheriff of Del Norte county, or better yet have a lawyer write to him on his letterhead. Explain the health issues involved, and attach documentation if possible. The letter should advise the sheriff that the guy is coming to do 22 days in jail and will require the following long list of medications, care, accommodations, etc. Send the letter certified mail return receipt requested. Do it right and the sheriff will sweat having to provide medical care or possible lawsuits, and he won't want him in his jail. This could possibly lead to an early release, assignment to a hospital ward, or other favorable outcome. The guy should also bring all his prescription bottles and medical documentation of special needs to the jail.
