Your question doesn't make sense. If the D.A. hasn't filed charges, then how could he "refile" at all, let alone "again"?
The D.A. can file charges until the limitations period runs out. Ordinarily, if he decides before then that he isn't going to file, he can change his mind until the last day of the limitations period.
