My daughter (16) was arrested for possession of lorazepam (she said 1-2 pills), charged with 11377 (a) H&S /F/. What can we expect?

Possession o lorazepam, unless it is possession for sale, is either an infraction or a misdemeanor. A misdemeanor can include jail time, up to 12 months, and a fine. The infraction will have a fine only. I would expect the juvenile court to require her to take some type of drug class for 6 months. She may qualify for deferred entry of judgment. She would be required to plead guilty to the drug possession. Then she would waive time for prosecution of the criminal action and the entry of the judgment. She would then participate in a six month drug program. Upon her successful completion of the drug program, prior to entry of judgment the guilty plea would be set aside by the court and the case would be dismiss the case. Her only record would be a juvenile arrest. Under current law this could be sealed and unavailable to the public. Consulting with attorney would be advisable.
