Re: Daughter Charged With Assault

My 15 yr. old daughter was charged with a 186.22(d)Gang Related Activity and Misdemeanor Battery charge. She has never been arrested ever in her life, and has never even been in a fight before. We recently moved to this town, that is known for Gang Violence. She only has one friend in this town. She does not know or affiliate with any gang members. She has had a lot of problem @ school because of her being new. Everyday she has been harrassed by other students. This charge occurred because 2 girls from from her school attacked her after school and her friends sister (an adult) seen and helped stop them, but continued to beat the girls up. The cops were called and 2 days later an Investigator from the Gang Enforcement Unit wanted to speak with her but would not allow me to come in the room when they were questioning her. The Investigator made her sign a contract stating that she was in a gang. So now her name is on a list for known gang members. The courts now sent me a letter stating that the People may seek to have her confined.

You need to retain an attorney to represent your daughter. Serious charges and a criminal record are possible in this case. You cannot help her by requesting assistance on the internet. She has the right to have a parent or attorney with her when being questioned. Her statement maybe subject to a motion to suppress it.
