Legal Question in Criminal Law in California

my daughter is going to court for drugs also with a guy friend that invited her to a fair in another town they are being charge as codefenfants.my daughter has no record they want to give her 5 years

You haven't really asked a question.

The determining factors in a drug case are first and foremost what legally admissible evidence they have and what intent they can prove.

With no record, 5 years seems outrageous unless we're talking a huge quantity of drugs or firearms being present.

Bottom line? She needs a damn good lawyer.
