Legal Question in Criminal Law in California

My daughter has a prior misdemeanor charge of drunk in public and was arraigned but never given legal representation. This is one, then on top of that she was caught trying to steal a bottle of alcohol from a local market. My question is can they be combined, is rehab an option. An about the first one without legal representation? since she had a prior misdemeanor does that mean jail time. Is that a violation of her probation? How much jail time. Should she have a lawyer or is it to late for that since she has the prior charge?

With regard to the first charge: Was her sentence only the misdemeanor charge and probation or was there anything else?

As to your question about the charges being combined: You may potentially be able to agree to a plea with the district attorney for both charges, if they were both brought by the same charging office.

Whether or not she faces jail time depends on a number of factors. First, how old is your daughter? Second, what were the terms of her first probation? It's never too late to seek the guidance of an attorney.
