Legal Question in Criminal Law in California

my daughter was questioned about an assault case, she was told she couldn't invoke her 5th amendment right because this isn't a court room! also there was a member of the sheriff's explorer scouts present who is friends with the alleged victim he's a minor and attends the same school as the alleged victim and others named in the questioning. were her rights violated on both the denial of 5th and the minor/student being present
