Declaration to Release Attorney of Record

Does signing such a declaration release an attorney from responsibility of mishandling a case or misrepresenting information to a client regarding his/her case.

The answer depends on the language of the declaration. If the release in general terms contains language that states you are releasing the attorney from liability arising from any incident in connection to the transaction then the answer is of course yes.

However if this declaration as it is generally used for only states facts for the court to justify the attorney to withdraw from the case as your attorney of record, then the answer is No. For more information you need to call.

In short - no. Being relieved as attorney of record does not relieve the lawyer from any legal or ethical obligations which might give rise to legal malpractice action by former client or discipline by the state bar organization.
