What exactly defines prostitution
My wife is looking to go into the escort buisness. She plans to put an ad on various websites saying something along the lines of ''call me up for a good time, call for prices'' when the client calls she will promise a smile on his face for a certain fee. Once she actually arrives she will stick to the promise for a smile on his face. She will never offer intercorse and will not perform intercorse. If she follows these guidelines and lands in a sting situation, does she have anything to worry about or is she within the law? Please any and all information that will keep my wife within the confines of the law would really help. Thank you

Your wife's ambiguous use of language may or may not deter a prosecutor from pursuing charges. I would recomend including language such as NO INTERCOURSE on the ad. However, we all know that ad an placed in certain sites is an ad for sexual services which is illegal.

California law defines prostitution as "any lewd act between persons for money or other consideration". This definition is much broader than intercourse. You haven't said what your wife will do to put a smile on her clients' faces, but the fact that you think it might amount to prostitution means it probably will. Merely running the ad you describe will be legal, but the services being advertised are another story.
