Legal Question in Criminal Law in California
If someone were detained but not charged, would anything go on their record?
If someone(s) were detained for Drunk In Public, but not given any chemical analysis or a ''breath-a-lizer'' to indicate their 'intoxification' level, and released 8 hours afterward with no court hearing, citation, or charge, what would go on their official record, if anything? Please Note: The person(s) was/were never read his/her rights during the detainment, and not told what he/she was being detained for until the in processing of him/her at the Police Station. And if this person(s) is/are in the Military, what, if anything can the member(s) be charged with? If there is no case, citation, hearing, charge...then what can be brought against him/her within the Military?
