Legal Question in Criminal Law in California

Dismissal of Rape Charges

I was recently held in regards to rape charges, the claim was made by someone other than the victim, who is a 20 yr old woman. i was given a certificate of release and under P.C. 849 (if im correct)i was released after ''the detective was satisfied there were insufficient grounds to file criminal charges against me''. it was consensual and there was absolutely no force involved. I also have a witness who can verify that physical contact was initiated by this woman. how safe am i from these charges resurfacing and should i contact the officer regarding the witness, who was mentioned in the original questioning/interview?

Re: Dismissal of Rape Charges

Thank you for your question. If you have a certificate of release and an admission by the detective that there's insufficient grounds, why are you looking for more?

You are never completely safe unless the statute of limitations expires, which can take years. However, I'm unclear as to how contacting the officer would get you anywhere. Best of luck.
