dismissed shoplifting offense and employment check

I was offered a job today and they will also do a background check with the Dept. of Justice. I had a shoplifting citation dismissed in 1998. I thought I was told it would not show up since it was dismissed - it is also in another county. Please advice ASAP. Thanks

There is a way to have it expunged from the record. Take a look at P. C. Sections 1203.44 to 1203.49.

However, remember that charges are dismissed by the D. A. because there wasn't enough evidence to successfully prosecute you and obtain a conviction.

So any attempt to expunge the dropped charges would take too long to do you any good on a background investigation that is taking place right now. Remember that civilian emloyers that are not doing a Federal Government contract will not have access to your criminal record.

However, you should have the dropped charges expunged from your record for future employment opportunities.
