Legal Question in Criminal Law in California
domestic battery
i have a court date coming in july for domestic battery against my girlfriend. i pulled her by her hair and down to the ground which was caught on security tape. This is my first charge, and I have since been in counseling with 2 therapists and a doctor and I have begun anger management classes. My girlfriend dropped charges, but the DA is pursuing it. Is there any way of pleading down to something less than a misdemeanor? if not, what sould i expect?

Domestic violence charges are not easy to beat as the DA will always pursue them very hard. You need to consult a good lawyer in your area as there are ways to fight your case although the tape evidence does not help at all.

Depending on the county, there should be a fair to high likihood of disposition w/out conviction with more so a "diversionary" type disposition ( most prevalent in the county courts handling more volume as to case load).
However, more facts are needed to more adequately render a consult as to probabilities.
There are a several courses of action which such a disposition may structured so as to achieve the diversionary result....again, additional facts are needed.
Assumming you have proceeded as described EVEN B/4 your initial court date; then you are on the right road.
Generally, if you seek an aggressive attorney you will be okay.
