Re: Domestic Violence

In a nutshell, battery is any offensive or unwanted touching. It could be as little as a little poke on the arm or spitting. It terms of physical contact it does not take much to be charged with battery. The key is the intent of the touching and how it was received by the alleged victim. Was the contact offensive, unwanted, etc?

Of course, battery can consist of more serious physical contact although something amounting to threat of great bodily injury would usually be charged as an assault.

Hope this helps.
