Legal Question in Criminal Law in California

In a domestic violence case, with a defendant that does not have a "clean" record, whom requested a trial, with a victim/witness who is "hiding out" because she doesnt want her boyfriend to go to jail, and trial has been continued on a daily basis for a week because the victim is not comming to court and trial was "dismissed" today and the DA stated they may chose to re-file on the defendant..is that possible and if so what can the defendant do in this case?
