Domestic Violence - difference between misdemeanor and felony
I had a meeting with my estranged husband at the airport when he was between flights. He began to yell and scream at me so I ran away from him. He chased me through baggage claim and out into the street. He grabbed and pushed me down. I spent 3 days in the hospital and suffered a severely broken foot. I've been out of work for 6 months and just had surgery. He was arrested, not yet charged. It's at the city atty's. I've handed over my evidence including everything from my restraining order hearing. From the police report there are two eye witnesses, Traffic police. One saw him push me. Both saw him chase me and reach to grab me. The judge awarded me the restraining order on the fact that he chased me through the airport.
Shouldn't this be a felony since I suffered broken bones? And what if anything can I do to push this criminal case and get him prosecuted?
