Legal Question in Criminal Law in California

domestic violence is this legal?

Two people are involved in a domestic case, they have reconciled, and the victim does not want the suspect to be prosecuted. The victim has asked the suspect if there's anything that they can do to help. Is it legal for the suspect to suggest to the victim that they contact the district attorney and let them know that they aren't interested in pursuing the case, and would like the charges dropped?

Two issues need to be considered. Asking or influencing a witnesses to change testimony against a criminal defendant is called witness tampering. This is a felony.

Second it is unlikely that the district attorney will dismiss charges merely because the victim makes that request. Often the da and court will cooperate with the parties to reconcile.
