domestic violence

how long does it take to press charges? how do i protect myself from charges if my ex girlfriend is wrongly accusing me of beating her up and stalking her? what are some possible onsequesces, and suggestions for defending myself?

It takes time for the police to get a report to the D.A., and sometimes the D.A. sends it back to the police for further investigation. You can call the D.A.'s office to find out if a complaint has been filed yet.

You can be charged with either a misdemeanor or felony, depending on how the D.A. wants to proceed. Depending on how serious the charges are, you could be given probation and ordered to attend anger management classes, or you could spend time in jail.

It takes anywhere from a few days to a few months to file the charges against you. If it takes much longer (a year), your attorney will have mechanisms for challenging those charges for being prejudicially late.

Domestic Violence is a felony, so I really do not recommend you defend yourself if those charges are filed. You should seek a public defender or, if you don't qualify for a PD, a private attorney.
