Legal Question in Criminal Law in California

domestic violence

i am the victim of a violent assault by my ex-boyfriend. I lost my left eye as a result. The case is set for readiness and prelim on 6/2 and 6/10/09 respectively. I have had to leave my home for personal safety. Today, two women claiming to be investigators from the public defenders office came to my mom's home where I have been recovering. I have stressed to the prosecutor and the investigator that I am terrified he will send someone to hurt me or my mom and have requested that my location not be revealed. Do I have the right to request that these people not come to my mom's house to question me?

Re: domestic violence

You have no legal obligation to speak to the Public Defender investigators at all. Certainly you can notify the Public Defender's office (best if you can direct the communication to the attorney who is in charge of the case) that you will not speak with them and not to send anyone to see you. You can have someone call for you, which is best.

Talk to the prosecutor on your case about having him send the PROSECUTOR's investigator (often retired cops) to escort you to and from court each time,if you will feel safer that way.
