Legal Question in Criminal Law in California

domestic violence

My wife and I got into an argument on New Years Eve. We were both very drunk. We tusseled with each other and she got hit in the face. Her friend called the police and I was arrested for domestic violence and corpral injury. I have never been convicted of anything and don't know what to do.

Domestic violence are serious cases, even if a misdemeanor slap on the face is involved. Even if your wife/girlfriend does not want to press charges it is going to be out of her hands as to whether you will be prosecuted. Do not attempt to defend yourself. Defending domestic violence is an art of sorts and a good attorney might be able to have the charges dismissed completely.

You need to get an attorney. You probably have an arraignment coming up. If you can't afford an attorney, request a public defender. Do not try to fight this yourself.
