Drug Court Rights
I was arrested for possession of methamphetamines and have a deferred sentence while attending the Drug Court Program. I live in the San Fernando Valley and my Drug Court is in Long Beach. I commute 6 hours everyday. There is a Drug Court Program in the Valley next to my home. What rights do I have and what procedures do I take to get transferred. The program refuses to transfer me due to their client numbers are low and they need the head count. I'm up at 6am and don't get home til 10:30p.m. My safety,health, and family is jeapordized. I don't want an excuse just a transfer to my area. Please help me.

The good news: you simply need the Court to order that you attend the program in your area. This shouldn't be a problem.
The bad news: this requires you to return to court in Long Beach (or wherever you were convicted) and get your case "advanced," that is, put on calendar that day. This requires you to go to the (criminal) clerk's office at 7:30a.m. and stand in line to request that they send your file into the courtroom and allow you to see the judge to request a "modification."
You will be told which courtroom to go to and the judge will call your case. When he does, stand up and explain that it is very difficult for you to attend the program so far away from your home and work; request that you be assigned to a center nearer to your home. You shouldn't have any problem.
If you do run into trouble, or if you need someone to appear for you to request the modification on your behalf (to avoid the hassle of having to appear yourself), or if you just want a little more coaching, feel free to give me a call or email me directly.
