Drug deversion

I was charged with a misdemeanor possession of a controlled substance. I pled guilty and received PC 1000. I was mistaken about the date by which I was suppose to enroll in my classes. A warrant was issued but i was unaware of this, i was pulled over for a traffic issue and of course taken to jail. My ? is do i have any chance of continueing PC 1000 instead of receiving Prop 36?

Judges are not all the same of course, but honest errors on dates for compliance do happen and I have seen many, many people given a second chance when they missed their deadlines. Hint: dress up real nice for court, hair combed, tie and jacket, assuming you are out of custody now (not many cells have internet access!) It might help. Be sincere, look the judge in the eyes, and assure him/her that you have every intention of complying. Good luck.

I suggest hiring an attorney to go in to court with you and convince the judge to give you a second chance. Usuallly the court does not like to give second chances for PC 1000, but if you convince the judge that you are willing to complete it and you have a decent excuse for not completing it the first time, you may be able to get reinstated.
