Legal Question in Criminal Law in California
Drunk driving
My husband was arrested for drunk driving and I would like to know what the most serious ramifications from this will be and would it be necessary to retain an attorney or will he be able to represent himself??

Re: Drunk driving
Assuming that this is his first offense and no one was injured the maximum sentence is 12 months county jail and a fine of $398 (plus the penalty assessment of 180% or $716 and additional fines and penalties) The total monetary fine generally exceeds $1,200.
Generally the first offense is 6 to 8 days in jail and the fine.
If this is the second or greater arrest within the last 7 years the fine could go up dramatically, and in the most severe case a state prison sentence.
If there was an injury to another person the maximum is state prison.
He should definitely be represented by an attorney in this matter.
