Legal Question in Criminal Law in California

Drunk in public

My husband was arrested for DUI, and I was arrested for 647(f) (drunk in public) in Bakersfield. I was kept in jail overnight and released in the morning. In reading the statute, 647(g), it implies that nothing more should happen. Am I misunderstanding the statute? I am to appear in court on the 647f on the 23rd of August.

Re: Drunk in public

You are correct if this is your first drunk in public or driving offense. Much more should not happen. However, I don't know your prior record and the statute provides for several months in the county jail.

Lots of luck.
