Legal Question in Criminal Law in California
DV charges
My boyfriend was arrested for domestic violence. He has hired an attorney that charged him a fee and said best they can do is try and get the DA to lower the time he will spend in jail. That does not sound like due diligence to me. He didnt even get to talk to the atty. The woman he talked to said if he paid them 5k they would try to get the DA to give him less than 6yrs. This sounds insane to me! Should he forfit that money and find another atty that will try to get him aquitted and/or probation, anger management etc.? Please help. This is a nightmare!

Re: DV charges
A lot of factors affect what kind of plea bargain is acceptable. If your boyfriend's exposure right out of the gate is 6 years, then it sounds like he is up against some very serious charges and that someone was seriously hurt.
I speak directly to all my clients and offer a free phone consultation. If your boyfriend would like to consider other options, have him call me.
Best of Luck!

How much injury did the victim suffer? DV ususally does not result in jail time. Get your money back. Contact me directly.
Re: DV charges
I'm astounded both by the fact that there are attorneys out there that won't speak to prospective clients, and that your BF hired somebody like that. Maybe I am marketing myself incorrectly and I should hide behind a secretary from now on so people will be impressed with how busy I must be.
Many DV cases can be successfully defended, but if he broke bones or something his options may be limited. But a privately retained attorney doesn't earn $5000 for merely taking the first deal that's offered. That quality of representation anybody can get from the public defender.
Re: DV charges
This absolutely does not sound right. Your boyfriend should terminate representation and go after the attorney for unearned fee, starting with arbitration through the State Bar.
You need to call around and talk to a few attorneys while considering your options. It is not possible to tell you more than that without knowing more facts about the case.
Feel free to call my office for a non-binding consultation.
