Legal Question in Criminal Law in California

electronic monitor

I've been on the electric monitor since the 1st week of jan after spending one week in jail. I'm being charged with 459PC ENH1' 182.1PC in which I've plead not guilty to and trial has been set for the end of March. My case has 2 other co-dependents and one is still in custody, and the other was bailed out. Everybody I talk to questions why I'm on the monitor and over $500 has been paid towards it so far. My PD has filed a motion to try to get me off the monitor because its become a financial hardship and I'm currently enrolled in PC 1000 program (which has been paid for) for DEJ so. My PD has put me on calendar again to ask the judge to O/R me because my family and I can't afford another $500. . I don't plan on missing a court date because I want to go to trial to prove my innocence. My criminal history consists PC1000 but I didn't have a probation officer or anything. I missed a drug court date &was arrested a week or 2 later and released next day. Also the judge who ordered me released on the monitor while I was in jail was the lawyer I had fired during juvenile dependency hearing. What can I do to maybe help persuade the judge or DA to O/R me. I don't want to go back to jail, esp for something I'm not guilty of.

Only a lawyer representing you and knowing full facts of your case as well as your personal life can effectively represent you at a bail/OR hearing. If you do not feel you are being effectively represented you should consult with and retain another lawyer.

I would not want to appear before a judge who is the lawyer I just fired. I would think that's good cause to have him removed from your case under CCP 170.1. Too bad you are stuck with the PD.
