Re: embezzlement

Penal Code Section 503. Embezzlement is the fraudulent appropriation of property by a

person to whom it has been intrusted.

Fraudulent appropriation - fact(s)

of property - fact(s)

by a person - fact(s)

to whom it has been entrusted - fact(s)

The district attorney at the trial needs to put some fact(s) into evidence to satisfy each of these elements of the crime. It's as simple as that.
