Legal Question in Criminal Law in California
Embezzlement that's been paid back
What is likely to happen if a person has been charged with embezzlement for around $3500, but restitution has been made with the owner who filed the charges? The owner of the business claims that prosecution will be stopped...The police department states that it will still go to the DA? What is likely to happen from here?

Re: Embezzlement that's been paid back
The crime occurred when the money was embezzled. Repayment of the money does not undo the crime. Repaying the money was a confession to the crime. This person should retain an attorney and not talk to the police or any other person about the incident.
