What is sentencing like in an embezzlement conviction?

Generally, 3 years in state prison, but this will depend on the nature of the crime and the individual convicted.

It depends on the amount claimed to have been embezzled, and on whether your attorney writes a sentencing memorandum, which if it is a felony, all attorneys should do.

I believe maximum exposure would be 3 years in state prison per each embezzlement or similar theft/fraud charge, if that is what you are asking. Also, the defendant will have to pay back the amount stolen, at a minimum.
