Legal Question in Criminal Law in California
erotic fiction legality
I publish a web site with sexual content, intended for adults only. It includes
fictional stories and personal accounts (text only), some of which describe
sex between minors or sex between adults and minors. Is this illegal in any
way? Is it the responsibility of the writer or the publisher or both?

Re: erotic fiction legality
You may be responsible, especially if the stories are true. Your best bet would be to limit these types of stories on your website. You should consult with an attorney to discuss modifications to your website and protecting yourself. You may also face civil liability. Please contact me if you would like a consultation.
