Legal Question in Criminal Law in California
Evidence
Immediate family member committed suicide, when police came they took the weapon used and my phone which was on the floor that I used to call 911. We have been trying to retrieve the items or 'evidence' but the police department has been giving us the run around. What can we do? Is there a specific form we need? Or should we try to find a lawyer for this? Are there any laws against this? Thank You

File a PC section 1538.5 motion requesting the return of the property. Retaining an attorney will greatly improve the probability of success.
