Legal Question in Criminal Law in California
What should I expect to happen in court on my Federal Felony charge?
I was arrested on June 7th, 2001 for Forgery, and attempted to pass counterfeit documents. Basically I tried to cash a counterfeit payroll check made out to me in the amount of $623.23 @ the bank. There was no transfer of funds. Also, I was already serving a PC1000- drug deversion class; possession charge pending, in which you are not to pick up any new charges for 18 months. I was about 2 weeks into my PC1000 class. What is going to happen to me?

When there is a violation of a PC 1000 probation there is (I believe) a minimum sentence that has to be given to you. It may be 10 to 30 days in the county jail. This is in addition to whatever sentence you'll get for what is essentially grand theft. I have a gut feeling that you can expect 30 to 45 days in the county jail for the forgery charge. Don't drop out of your drug classes.
Hopefully, you'll get some brownie points for that.

You're in some serious trouble because of the probation and the new case. I would recommend you talk to a lawyer in your area before going to court on either matter, because the variety of choices and options is dizzying, and because only with legal advice can you make the right choices for you, considering your situation.
